貿易法專題研究
Seminar on International Trade Law
In this semester, the focus will be on treaty interpretation under WTO. The following issues will be covered:
1. Comparison between treaty interpretation and contract and law interpretation.
2. Difference between treaty interpretation and treaty application
3. Difference between treaty interpretation and assessment of fact
4. Treaty interpreters in general and under the WTO
5. Role of Vienna Convention on the Law of Treaties (VCLT) under the WTO
6. Good faith principle and treaty interpretation
7. Ordinary meaning and treaty interpretation
8. Context and treaty interpretation
9. Object and purpose and treaty interpretation
10. Circumstances of conclusion and preparatory works
11. Hierarchy and holistic approach
13. Other principles
14. Time factor and treaty interpretation
15. Technology development and treaty interpretation.

To have the participants
1. Become familiar with international trade rules
2. Acquire some knowledge about treaty interpretation

課程要求 |
1. The course will be conducted in English.
2. It is useful (but not required) if the participants already have some international trade law background.
3. Participants are expected to participate in the discussions actively. |
