課程概述

To guide students of the comparisons and distinctions with respect to international arbitration theory and practice in major arbitration jurisdictions in the Greater China region.

The course will introduce students to the arbitration systems in the Greater China region – Mainland China, Hong Kong and Taiwan – covering their major distinctions and comparisons in the arbitration theory and practice, as well as rules and practices by leading arbitration institutions in the region, i.e. CIETAC, BAC and SCIA in Mainland China; HKIAC in Hong Kong; and CAA in Taiwan.
There is indeed a sufficient need for information on arbitration in the Greater China region, particularly in respect of the growing economic importance of the region, and the increasingly tighter economic relations among each jurisdiction in the region.
The fact of tighter economic ties among Greater China jurisdictions however does not follow that arbitration regulations and practices within the region are similar. The different histories of arbitration, and different legal traditions among these Greater China jurisdictions have all contributed to the very distinctive way of each of the arbitration system, which makes the teaching of this course all the more interesting, especially from a comparative point of view.

課程目標
- To understand the use of arbitration in resolving commercial disputes in the ever-growing business market in Greater China.

- To have contextual picture of the distinctions of the arbitration system in each of the Greater China jurisdiction, through class readings, seminar discussions, and videotape analysis. The theoretical material will be combined with practical examples for a better understanding of the uniqueness of each of the arbitral system in the Greater China region.

- To critically analyze the merits and demerits of the arbitration practices in each Greater China jurisdiction; advantages and disadvantages of their leading arbitration institutions for different types of disputes and parties, so as to make rational advice with respect to the forum and applicable law choices in the Greater China region.

- To consider ways in which the various strengths of arbitration systems in the Greater China region can be combined and collaborated so as to provide more convenient, effective, dynamic and integrated system of arbitration in the Greater China inter-regional businesses such as reciprocal enforcement of arbitral awards. 
課程要求
This course will be assessed by completing a research paper (100%) (12 font size, 1.5-line space). The research paper shall be concentrating on a topic of dispute resolution in Greater China of your own choice. In choosing the topic, students are encouraged to discuss with the teacher in class.

Research Paper 
100% 
This course will be assessed by completing a research paper (100%) (12 font size, 1.5-line space). The research paper shall be concentrating on a topic of dispute resolution in Greater China of your own choice. In choosing the topic, students are encouraged to discuss with the teacher in class. In assessing your Research Paper, the examiner will have regard to the extent to which you have: - the ability to identify relevant legal issues and prioritize their relative importance; - the level of clarity and accuracy in referring to and critically analyzing the law (statutory provisions, policies, judicial interpretations) and cases; - the ability to probe into economic and social analyses apart from pure legal approaches in the Chinese legal context; - the degree of coherence in organizing and synthesizing his/her own arguments and evaluations on the issues raised in the question; and - the ability to express the student’s own ideas in a succinct, precise and coherent manner.
