The purpose of the course is to give to the students an understanding of European legal issues that raise for the EU when conducting its international relations with a focus on what is more specifically at stake with Asian partners.
Prof. Isabelle BOSSE-PLATIERE will be in charge of the first part of the course (9 hours). It will deal with the legal framework of the Common Commercial Policy (CCP) of the European Union (EU), as it is considered as the most integrated policy of the EU. Three main aspects will be studied. A first aspect will present the CCP as an element, probably the most important element, of the external action of the EU. It will go over the history of this policy, the context of its adoption, its objectives and tools. It also will analyze the link of the CCP with the other fields of external action of the EU, especially the European development policy. Then, a second aspect of the course will focus on the question of the exclusive competence of the EU to adopt common rule concerning international trade. The relevant case law of the European Court of Justice will be analyzed. Finally, a third aspect of the course will focused on the institutional aspects of the CCP. In particular, it will deal with the negotiation and conclusion proceedings of external trade agreements and the role of the institutions: European Commission, Council of the EU and European and national Parliaments.
Prof. Cecile RAPOPORT will be in charge of the second part of the course which will focus on EU-Asia Partnerships and Trade Agreements. The course will focus on EU-Asia Partnerships and Trade Agreements. It will go over a brief EU’s strategy towards Asian partners. Then it will focus on the different types of international agreements that the EU has or is negotiating in Asia. Examples of several agreements will be more specifically studied. Being studied from an EU law perspective, the objective will also be to understand how institutional European issues tend to influence the content and the form of EU’s international agreements with Asian partners.

Pre-requisite:
Preferably, the students attending this course will have a minimum knowledge in international public law (treaty law and international economic law/WTO law). A knowledge of the basics of EU institutional law would be helpful.

Maximum capacity: 50 students
