課程概述 |
本課程於本學期中,將有重大轉變。從最近人工智慧的興起以及其對於現行法律、倫理、社會等的挑戰出發,逐漸探討人工智慧對於現今各種法律領域所帶來的衝擊和挑戰。究竟人工智慧可不可以擬人化,進而享有法人格地位而成為各項法規範的權利及義務主體,從而改變各該法規範現行規範基本模式,將是未來10年人工智慧發展對於法律所帶來的重要挑戰。在我國科技部門主管機關傾全力發展人工智慧的目標下,我國法未來應如何配合此一科技發展適當調整,並配合國際發展趨勢而與國際法律規範調和,令法規範不致成為人工智慧科技發展之障礙,當是未來人工智慧法律相關研究的重要課題。

本課程將循序漸進由人工智慧科技發展對未來社會、經濟生活的影響、法規範對此科技衝擊應有的基本對應方針及理念、人工智慧的公共政策、倫理議題、人工智慧法研究的必要性、人工智慧是否應享有法人格、人工智慧科技發展與隱私權保護、無人駕駛車相關法律議題、人工智慧與消費者保護、人工智慧的競爭法議題、人工智慧與金融科技創新及公司治理、人工智慧的智慧財產法議題、人工智慧對於刑法、行政法之挑戰、人工智慧對於未來法律職業的影響等之概觀,逐步理解人工智慧對於現行法規範所可能帶來的各種衝擊。 |
課程要求 |
鑑於本課程並無一本統一的教科書可資參考,且國內可資參考資料幾乎欠缺,因此同學們將藉由外國文獻的閱讀及報告,逐次了解本課程之內容。於外國文獻之閱讀及報告上,將可能產生相當程度的負擔,同學必須確定對於本課程有強烈的興趣及學習欲望,並可配合本課程之進度閱讀相關文獻,方建議選修本課程。 |
