Due to the current situation with the Coronavirus, the course is cancelled in this semester.
Course description
The emergence of globalisation and technology in recent years has resulted in the concomitant rise of cross-border trades and the mass migration of goods, services and capital across borders. This has led to increased harmonisation efforts in the law, the rise of so-called “transnational law”, as well as an increase in the use of alternative dispute resolution mechanisms, in particular international commercial arbitration, to settle cross-border disputes. At the same time, globalisation and technology have played key roles in the popularity and surge of FinTech in today’s world. New platforms and methods of payment, lending, investment etc. have resulted in the need to re-think existing laws and regulations in the financial services industry and related areas. The potential of smart contracts to drastically reduce the need for law enforcement officers and decision-makers is also likely to have a massive impact on existing dispute resolution mechanisms.
This course seeks to introduce students to the key concepts and ideas in FinTech and Transnational Legal Practice from a legal perspective. Through interactive sessions including British Parliamentary style debates, students will have the opportunity to explore and analyse this topic, and will also be introduced to different legal sources and material including case-law, convention and legal literature. Students will have the option of completing a written assignment and will be taught to develop their analytical and critical reasoning skills, as well as oral and written advocacy skills.
