課程概述

The World Trade Organization (WTO) serves as the only and the most important multilateral institution addressing the rules of trade between nations. In today’s globalized world, as trade increases and regional market integration deepens, legal issues of international economic relations are becoming more and more complicated. The issues facing the WTO are widening and go beyond a purely trade dimension. It is of immense importance for law students to have some broad understanding about WTO laws so as to know the essence of globalization and economic integration. The basic knowledge of WTO is also useful for understanding other fields of law, such as intellectual property law, service related laws (financial regulations, telecommunication laws, among others), international health law, and public international law. This course will be conducted in English.

2. Dispute Settlement Understanding
3. Border Measures: Tariffs and Quantitative Restrictions
4. Most-Favoured-Nation Treatment
5. National Treatment
6. General Exceptions
7. Regional Trade Agreements
8. Agreement on Technical Barriers to Trade
9. Agreement on Sanitary and Phytosanitary Measures
10. Antidumping
11. Subsidies
12. Safeguards
13. Trade in Services: Principles, Liberalization, Specific Sectors and other Disciplines
14. TRIPS Agreement: Principles, Individual Intellectual Property Rights and Enforcement

There will be two guest speakers to deliver speeches.

 

課程目標
The course is designed to cover the fundamental aspects of the WTO law so that participants will be equipped with basic WTO law knowledge and skills. 
課程要求
1. Most class sessions will be conducted by students’ group presentations, discussions and lectures.
2. Students will be expected to form a team to make a 40 minute group presentation with PowerPoint slides on relevant topics according to class schedule. The Power-Point slides should be delivered to the instructor and students by email or other online means a week prior to presentation. Team members must attend classes on the day of presentation.
3. Attendance for all classes and active class participation is strongly encouraged. In no event, the participants should miss two or more classes without good reason.
4. The course evaluation will be based on class participation (30%), the group presentation (30%) and the final term examination (40%).
5. The class schedule could be adjusted according to the actual number of students taking this class and the discussions in the classes.

2. Other materials that can be found at the WTO website.
3. For those who can read Chinese, the text book “International Trade Law: New Legal Order under the WTO” (by Professor Chang-fa Lo) and “WTO Law and Practice” (by Professor Tsai-yu Lin) are additional references.
4. Participants should always bring the texts of WTO agreements to the class each time. The texts can be downloaded from WTO official website.
