課程目標 |
This course invites students to think, discuss and have fun. It should enable students to:
• Know something of and think critically about the main theories explaining the major features of contract law;
• Consider how these theories deal with some foundational anchors such as ‘autonomy’, ‘freedom of contract’, ‘the intention of the parties’, ‘vitiation’ and ‘expectation interest’;
• Consider the extent to which these theories ‘fit’ with the common law;
• Consider the appropriate role of the state in regulating the activity of contracting, eg consumer protection, contracts to sell body organs etc;
• Consider how contract law both mirrors and shapes society’s conception of human interaction and human good; and
• Be able to engage in normative analysis of the law (how the law should be) with a view to desirable law reform |

20 minute Presentation of allocated reading |
20% |
Be as creative as you like in:
-Presenting a summary of the reading;
-Linking it to the ‘questions to consider’ for that week;
-Giving your own assessment of the piece.
Our most human characteristic is not the ability to learn, which we share with other species, but our ability to teach and store what others have developed and taught us.
To teach is to learn twice. |
2. |
Class participation |
20% |
This will be based on:
1. Your preparedness for and engagement during the classes and seminars demonstrated by your contributions in questions and comments.
2. Your willingness to ‘have a go’ and get involved even if you’re not sure.
The stages of knowledge:
1. I don’t know what I know
2. I don’t know what I don’t know.
3. I know what I know.
4. I know what I don’t know. |
3. |
Research Paper |
60% |
This should be a paper of 4,500- 5,000 words (this word-count to include footnotes, but not including bibliography) in the form of an argumentative essay. You should take a position and defend it with reasoned argument. This will be assessed by reference to:
1. The overall structure of your paper,
2. The presence of a clear argument;
3. The strength of the argument and depth of your analysis of the issues; and
4. Your appreciation of opposing arguments and ability to respond to them fairly and effectively.
Plagiarism: Disciplinary action will be taken against any student found plagiarizing. |
