課程概述

什麼是「異性戀霸權」（heterosexual hegemony），也就是Andrienne Rich所稱的「強迫異性戀」（compulsory heterosexuality）？強迫異性戀是對於典型異性戀圈外人，亦即所有非典型異性戀者（non-heterosexuals，包括同性戀、雙性戀…）的排除性歧視，或者是一套性別宰制的機制？法律如何製造/強化/再製強迫異性戀機制，同時又作為挑戰、拆解霸權的場域（contested site）？在不同的歷史階段中，強迫異性戀機制的形貌為何，法律又扮演了何種角色？
本學期的課程將以強迫異性戀機制為中心，以美國為空間，探究強迫異性戀機制在美國的歷史形貌與法律角色。在初步瞭解強迫異性戀的機制，思考歷史化的必要性與法律的角色之後，我們將閱讀兩個重要的文本：由女性主義法學和法律史學者Linda Hirshman和Jane Larson所共同撰寫的Hard Bargains: The Politics of Sex (NY: Oxford University Press, 1998)，以及日裔美人男同志法學者Kenji Yoshino所發展出的「掩飾」（covering）理論，藉以由理論和歷史來思考強迫異性戀機制的傷害以及可能的出路。最後，我們將由兩個面向來思考歷史與2003年的重要里程碑判決Lawrence v. Texas的關係：歷史如何影響此判決？如何將此判決置於歷史的脈絡？
 

課程目標
 瞭解強迫異性戀機制的歷史形貌，並思考法律的角色。 
課程要求
 本課程非常重視同學們對每週閱讀材料的研讀理解思辯、上課的積極參與、以及報告的撰寫。課堂參與和讀書心得將佔學期成績的50％，期末報告占50％。課堂參與和讀書心得為：
1. 必須輪值報告，並提供包括摘要、提問的報告大綱，報告大綱應於輪值報告的前一日下午六點之前，發表於課程網站中。未負責報告之同學，則應於同一時間之前，於課程網站中發表至少兩個提問，於學期中至少應發表10次提問。輪值報告者，於課堂報告中應整理並回應其他同學的提問。
2. 共計應繳交三次各約2000-3000字的讀書心得，分別針對強迫異性戀機制與法律和歷史的關係（4/1繳交）、Linda Hirshman和Jane Larson的Hard Bargains（4/30繳交）、Kenji Yoshino的Covering（5/29繳交）。
